1. Definitions

1.1 In these Terms and Conditions, the following definitions apply:

1.2 "The Lessor" refers to Bourne 2 Hire Limited.

1.3 "The Hirer" means the person, company, or entity hiring the vehicle as indicated in this agreement.

1.4 "The Vehicle" includes the specific vehicle described in the rental agreement, all parts, tires, tools, accessories, and equipment.

1.5 "Hire Period" means the period starting from the date and time specified in the rental agreement until the vehicle is returned to the Lessor, including any agreed extensions.

1.6 "Rental Charges" means the amounts payable by the Hirer for the hire of the vehicle, as detailed in the rental agreement.


2. Hirer's Obligations

2.1 The Hirer is responsible for ensuring any authorized driver adheres to this agreement's terms.

2.2 The Hirer must ensure the vehicle is driven lawfully and complies with all applicable road traffic laws and regulations.

2.3 The Hirer must use the correct type and quantity of fuel for the vehicle as specified. If incorrect fueling occurs, the Hirer is liable for all repair costs.

  1. 2.4.1 Any illegal activities or purposes.
  2. 2.4.2 Carrying passengers or goods for hire without the Lessor's prior written consent.
  3. 2.4.3 Racing, rallying, speed testing, or driving tuition.
  4. 2.4.4 Towing any vehicle, trailer, or other object without the Lessor's prior written consent.
  5. 2.4.5 Driving outside England, Scotland, and Wales without prior written consent.
  6. 2.4.6 Being driven by anyone unauthorized by the Hirer.
  7. 2.4.7 Being driven by anyone under the influence of alcohol, drugs, or other substances that impair driving ability.
  8. 2.4.8 In a manner that may cause damage or compromise the vehicle's safety.


3. Payment

3.1 The Hirer must pay the Rental Charges to the Lessor as specified in the rental agreement.

3.2 The Hirer must pay the Lessor, on demand, all additional charges incurred during the Hire Period, including:

  1. 3.2.1 The cost of refueling if the vehicle is returned with less fuel than at the start.
  2. 3.2.2 Repair costs for any damage not covered by the Lessor's insurance.
  3. 3.2.3 Fines, penalties, or charges incurred during the Hire Period, including administrative fees for processing these fines.
  4. 3.2.4 Any additional charges specified in the rental agreement, such as for optional extras, additional drivers, or extended Hire Periods.


4. Insurance

4.1 The vehicle is insured by the Lessor under a comprehensive motor vehicle insurance policy, subject to the policy's terms.

4.2 The Hirer is liable for the insurance excess or any amounts not covered by the Lessor's insurance if the vehicle is damaged or lost.

4.3 The Hirer must not do anything to invalidate the Lessor's insurance or reduce its coverage.

4.4 If the Hirer opts to use their own insurance, they must provide proof of adequate insurance before the Hire Period begins.


5. Maintenance and Repair

5.1 The Hirer must immediately notify the Lessor of any loss, damage, or fault affecting the vehicle.

5.2 The Hirer must not arrange or undertake any repairs or maintenance without the Lessor's prior consent, except to prevent further damage or ensure safety.

5.3 The Hirer is responsible for routine checks, including oil, water, and tire pressure, to maintain the vehicle's roadworthiness.

5.4 The vehicle must be returned in a clean and tidy condition, and the Hirer is liable for any cleaning or valeting required.


6. Return of the Vehicle

6.1 The Hirer must return the vehicle to the Lessor at the specified location, date, and time, or as otherwise agreed.

6.2 The vehicle must be returned in the same condition as at the start, except for fair wear and tear.

6.3 If returned outside business hours, the Hirer remains liable for any loss, damage, or theft until the Lessor checks in the vehicle.

6.4 If the vehicle is not returned on time, the Hirer is liable for additional rental charges until it is returned.


7. Liability

7.1 The Lessor is not liable for any loss, damage, or injury to the Hirer or third parties due to vehicle use, except due to the Lessor's negligence.

7.2 The Hirer must indemnify the Lessor against all claims, costs, and expenses from vehicle use, including personal injury, property damage, and consequential loss.

7.3 The Lessor is not liable for indirect or consequential losses suffered by the Hirer, including loss of profits or business.


8. Termination

8.1 The Lessor may terminate the rental agreement if the Hirer breaches any terms of this agreement.

8.2 Upon termination, the Hirer must return the vehicle and pay any outstanding charges, including repair costs and compensation for loss of use.


9. Governing Law

9.1 This agreement is governed by the laws of England and Wales.

9.2 Disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.


10. Miscellaneous

10.1 Amendments to this agreement must be in writing and signed by both parties.

10.2 If any provision is found invalid or unenforceable, the remaining provisions will continue in full force.
